Zoning regulations of Labette County, Kansas were effectuated by Resolution No. 2024-24-L on July 12, 2024. These regualtions apply to the unincorporated areas of Labette County except the extraterritorial zoning and subdivision around the City of Parsons. This jurisdiction about Parsons includes land in Labette, Liberty, North, and Walton townships of Labette County, KS. Agricultural Uses are exempt as provided by State statutes.
These regulations apply to the Great Plains Industrial Park (GPIP) solely as an overlay district and utilize underlying zoning districts established for GPIP by the Labette County Zoning Code adopted by the Board of County Commissioners by Resolution No. 2011-42-L on September 19, 2011.
All lawfully existing structures and uses which were in existence prior to the effectuation of Resolution No. 2024-24-L and are not otherwise permitted by the Zoning Regulations are grandfathered as legal nonconforming structures and uses.
Labette County Zoning Regulations require zoning permits and occupancy certificates.
The Zoning Department consists of a Zoning Administrator, appointed by the Board of County Commissioners, who is responsible for processing applications for zoning variance amendments, zoning appeals, zoning permits, occupancy certificates, conditional use amendments, and maintaining such public records. The Zoning Administrator advises the Planning Board. In addition, the Zoning Administrator must ensure compliance with zoning regulations and resolutions.
The Planning Board members are appointed by the Board of County Commissioners. Duties include maintaining the land use plan and conducting public hearings to consider zoning the conditional use cases.
The Board of Zoning Appeals consists of members of the Planning Board. Their duty is to consider appeals regarding decisions made by the Zoning Administrator in the enforcement of the Zoning Regulations.
